EADly Terms of Use
Effective date: June 25, 2026
These Terms of Use (“Terms”) govern your use of the EADly mobile application and the eadly.app website (together, the “Service”), which is published and operated in the United States by Ethos Systems, LLC (“we”, “us”, “our”), a Wyoming limited liability company, under license from its licensor (see Section 7). By using the Service you agree to these Terms. If you do not agree, do not use the Service.
These Terms work together with our Privacy Policy, which describes how the Service handles information and forms part of these Terms.
Important, please read first
- EADly is an informational tool only. It tracks the dates you enter and restates official rules with links to government sources.
- EADly is not a law firm and does not give legal or immigration advice. Using it creates no attorney-client relationship.
- Your employer and their attorney file H-1B and other petitions, not EADly. EADly only helps you keep track of dates.
- Always verify every deadline and requirement with official USCIS sources, your DSO, and a qualified immigration attorney before acting.
1. What EADly is, and what it is not
EADly is an informational organizational tool. It helps people on F-1 student status track their OPT and STEM OPT timelines, deadlines, employment and unemployment-day records, CPT records, travel readiness, reporting obligations, and immigration documents, and it helps people moving from F-1 to H-1B keep track of their own transition dates. It also offers optional conveniences such as deadline reminders, USCIS case-status tracking, a lookup of public H-1B employer data, calendar and document export, and a place to store copies of your own immigration documents (including photos you take of them). EADly records only the information you enter and the public government data you choose to look up, and it restates official rules with links to government sources. EADly is designed to work on your device without an account; signing in and cloud backup are optional (see Section 3).
EADly is not a law firm and does not provide legal or immigration advice. Using the Service does not create an attorney-client relationship. All information in the Service, including calculated deadlines, unemployment-day counts, phase and cap-gap determinations, travel-risk indications, reminders, and case-status displays, is provided for general informational purposes only. It may be incomplete, outdated, or inapplicable to your individual situation. Immigration rules change, and your circumstances are unique.
H-1B and other petitions are filed by others, not by EADly. EADly does not prepare, file, or submit any petition, application, or government form, and does not transmit anything to USCIS on your behalf except optional USCIS case-status checks you choose to enable (Section 6). H-1B petitions are filed by your employer and their attorney; EADly only helps you keep track of dates. Your employer, their attorney, and your Designated School Official (DSO) determine what applies to your case.
You are solely responsible for your immigration compliance. Always verify all dates, deadlines, and requirements against official USCIS sources, your DSO, and/or a qualified immigration attorney before acting. Never rely on the Service as your only source for a legal deadline.
2. Eligibility
You must be at least 16 years old to use the Service. By using the Service you confirm that you meet this requirement.
3. Your account
EADly is local-first: its core features work entirely on your device, and you can use EADly without creating an account. Some optional features (cloud backup and sync, USCIS case-status auto-tracking, and in-app feedback) require an account created with your email address via one-time codes (OTP). We do not use passwords. You are responsible for maintaining access to your email account and for all activity under your account, and you must provide accurate information.
App lock (PIN and biometrics). EADly offers an optional app lock (a PIN plus optional biometric unlock such as Face ID or fingerprint) to help protect the data on your device. It is separate from signing in, is offered to every user, and can be skipped. Your PIN is stored only as a salted cryptographic hash on your device; we never see it. If you forget your PIN, you can reset it by verifying your email with a one-time code; if you have not connected an account, resetting the lock may require clearing the app’s data on the device. You are responsible for remembering your PIN.
Cloud backup, your passphrase, and your recovery code. Cloud backup is optional and is off until you enable it. As described in our Privacy Policy, every cloud backup is end-to-end encrypted. Your data is encrypted on your device before it is uploaded, under a key protected by both a passphrase you choose and a one-time recovery code generated when you enable backup. Your passphrase and recovery code never leave your device. Because of this design, the server stores only encrypted ciphertext: Ethos Systems, LLC, its backend provider, and our cloud provider cannot read the contents of your cloud backup and cannot reset your passphrase. A backup can be unlocked only with your passphrase or your recovery code.
You are responsible for safeguarding both your passphrase and your recovery code. Keep them somewhere safe and private. If you lose both your passphrase and your recovery code, your cloud backup cannot be recovered by anyone, including us. The data stored on your device is unaffected. You acknowledge and accept this design.
Local export and import. Whether or not you use cloud backup, you can export your data to a file on your device, and import it again later, at any time and without an account. This gives you a no-cost way to keep your own backup independent of cloud backup.
4. Acceptable use
You agree not to do any of the following:
- Use the Service for any unlawful purpose, or in violation of any immigration, export, sanctions, or other law.
- Use the USCIS case-status feature to look up receipt numbers other than those for cases you are entitled to track.
- Store or upload documents or content that are not yours, or that you do not have the right to store.
- Use the H-1B employer-data lookup or other government-data features for any unlawful, discriminatory, or harassing purpose.
- Attempt to probe, breach, or test the security of the Service, or access data belonging to another user.
- Reverse engineer, decompile, or extract source code from the Service, except where permitted by law.
- Interfere with the operation of the Service, including by overloading, flooding, or circumventing rate limits.
- Resell, sublicense, or commercially exploit the Service without our written agreement.
- Submit content that is unlawful, infringing, or harmful.
We may suspend or terminate access for violations of these Terms.
5. Subscriptions and purchases
Some optional features are offered through a paid subscription called EADly Plus. The safety-critical basics (your timeline, deadline calculations, deadline reminders and notifications, the unemployment-day counter, and links to official resources) are part of the free version and are not placed behind the subscription. EADly Plus adds optional conveniences, which may include cloud backup and sync, USCIS case-status auto-tracking, the detailed H-1B employer-data lookup, an expanded document vault, reminder customization, attorney-ready exports, and priority support.
EADly Plus is an auto-renewing subscription. Where it is offered, the price, the billing period (for example, monthly or annual), and any free trial or introductory offer are shown to you before you purchase. Purchases are processed by the Apple App Store or Google Play Store under their payment terms, not by us directly, and are charged to your store account. Unless you cancel at least 24 hours before the end of the current period, the subscription renews automatically and your store account is charged for the next period. A free trial, if offered, automatically converts to a paid subscription unless you cancel before the trial ends. You can manage or cancel your subscription, and request refunds, through your Apple or Google account settings, subject to the applicable store’s policies; we do not separately process store payments or refunds. You can restore an active subscription using the “Restore Purchases” option in the app.
We may change subscription pricing, the features included, or the division between free and paid features on a going-forward basis, with notice for material changes; changes will not affect a subscription period you have already paid for.
6. Third-party services and links
The Service links to and interacts with third-party services, including official U.S. government websites, the USCIS Case Status service, and U.S. government datasets such as the USCIS H-1B Employer Data Hub. We do not control these services, are not responsible for their content or availability, and do not warrant the accuracy of information they return. Government data shown in the app, such as case status and historical H-1B employer figures, is reproduced as received and may lag, be incomplete, be unavailable, or differ from official records.
About the H-1B employer data. Historical H-1B employer figures describe past filings only. They are not a prediction or guarantee that any employer will sponsor you or anyone else, and you should not make employment, financial, or immigration decisions based on them alone.
7. Intellectual property
The Service, including its software, design, text, and branding (including the “EADly” name and logo), is owned by Arkand Labs Private Limited and licensed to Ethos Systems, LLC, which operates, publishes, and maintains the Service in the United States under that license, and is protected by applicable intellectual-property laws. We grant you a limited, non-exclusive, non-transferable, revocable license to use the app for personal, non-commercial purposes on devices you own or control. You retain all rights to the data and documents you store in the app.
8. Privacy
Our Privacy Policy describes how the Service handles information and forms part of these Terms.
9. Disclaimers
The Service is provided “as is” and “as available,” without warranties of any kind — whether express, implied, or statutory, including the warranties of merchantability, fitness for a particular purpose, accuracy, and non-infringement. In particular, we do not warrant that:
- Any deadline, date calculation, unemployment-day count, phase or cap-gap determination, travel-risk indication, or reminder is accurate, complete, current, or applicable to you.
- Any USCIS case-status result is accurate, up to date, or matches official government records.
- Any H-1B employer-data result, travel-readiness indication, or other output predicts or guarantees any outcome. This includes employer sponsorship, admission to the United States, or approval of any immigration benefit.
- Notifications will be delivered on time, or at all. Device settings, operating-system behavior, and other factors beyond our control affect delivery.
- The Service will be uninterrupted, error-free, or secure.
Immigration deadlines can have serious consequences. Always verify every date and requirement with official USCIS sources, your DSO, and a qualified immigration attorney before you act.
10. Limitation of liability
To the maximum extent permitted by law, Ethos Systems, LLC and its members, managers, employees, and suppliers — together with its licensor and backend provider — will not be liable for any indirect, incidental, special, consequential, or exemplary damages. This includes loss of immigration status or benefits, missed deadlines, lost employment or income, loss of data, or the cost of substitute services. This applies whether the claim arises from your use of the Service or your inability to use it, and even if we were advised of the possibility of such damages.
To the maximum extent permitted by law, our total aggregate liability for all claims relating to the Service will not exceed the amount you paid us for the Service in the twelve (12) months before the event giving rise to the claim. If you have paid us nothing, our total liability will not exceed one hundred U.S. dollars (USD 100).
Some jurisdictions do not allow certain exclusions or limitations; in those jurisdictions, the above applies to the fullest extent permitted.
11. Indemnity
You agree to indemnify and hold us, and our licensor and backend provider, harmless from claims, damages, and expenses (including reasonable legal fees) arising from your violation of these Terms or your misuse of the Service.
12. Termination
You may stop using the Service and delete your account at any time (Settings → Delete Account). We may suspend or terminate the Service or your access to it for breach of these Terms, legal requirement, or discontinuation of the Service, with reasonable notice where practicable. Sections 1 and 7–15 survive termination.
Service transfer, change of operator, or closure. If we discontinue the Service, transfer its operation to a new operator, or wind down our business, your data will be handled as described in our Privacy Policy, including its return-or-deletion commitments, and we will give notice in the app where reasonably possible. You can export your data at any time using the app’s encrypted backup (Section 3) to keep an independent copy or move it to another operator of the app. Production access to the USCIS Case Status service is tied to the current operator’s own U.S. government authorization and is not transferable. Case-status auto-tracking may therefore be unavailable while a successor operator obtains its own access. The rest of EADly continues to work on your device.
13. Changes to the Service or these Terms
We may modify the Service or these Terms. For minor or clarifying changes, we will post the updated Terms with a new effective date.
For material changes, we will notify you in the app before they take effect, show you a plain-language summary of what has changed, and ask for your active consent (an explicit “I agree”) before the changed Terms apply to you and before you continue using the optional online features (account, cloud backup, and USCIS case-status checks). If you do not agree, you can keep using the on-device features under the prior Terms, export your data, or delete your account.
14. Governing law and disputes
These Terms are governed by the laws of the State of Wyoming, United States, without regard to its conflict-of-laws principles. You and we agree that the state and federal courts located in Wyoming shall have exclusive jurisdiction over any dispute arising out of or relating to these Terms or the Service, except where mandatory consumer-protection law in your country or state of residence provides otherwise.
15. Apple App Store and Google Play
If you download EADly from the Apple App Store or Google Play Store, you also agree to that store’s terms, and the following apply to the extent your copy was obtained there:
- These Terms are concluded between you and Ethos Systems, LLC only, and not with Apple Inc. or Google LLC (each, a “Platform Provider”). The Platform Providers are not responsible for the Service or its content.
- Your license to use the app is a non-transferable license to use it on a device you own or control, as permitted by the applicable App Store or Google Play usage rules.
- The Platform Providers have no obligation to furnish any maintenance or support for the Service. We are solely responsible for product support, which you can reach at support@eadly.app.
- As between us and the Platform Providers, we are responsible for addressing any claims relating to the Service, including product-liability claims, claims that the Service fails to conform to legal or regulatory requirements, and claims that the Service infringes a third party’s intellectual-property rights, to the extent required by applicable law.
- You represent that you are not located in a country subject to a U.S. Government embargo or designated as a “terrorist-supporting” country, and that you are not listed on any U.S. Government list of prohibited or restricted parties.
- Apple Inc. and its subsidiaries are third-party beneficiaries of these Terms, and upon your acceptance Apple has the right (and is deemed to have accepted the right) to enforce these Terms against you as a third-party beneficiary.
