Can you work while your OPT or STEM OPT application is pending?

For post-completion OPT, the regulation says work can't begin before your EAD's start date, and USCIS tells employers not to accept a receipt for an initial EAD. Under the regulation, a timely STEM OPT application can extend work authorization until USCIS decides, up to 180 days. USCIS says cap-gap covers work only if OPT was valid at H-1B filing.

Summarized from official sources, checked October 22, 2026. Official pages change; follow the linked source if it differs from this summary.

The answer depends on what is pending. A first post-completion OPT application, a STEM OPT extension and an H-1B petition in cap-gap each follow different rules. On-campus jobs and volunteer roles have rules of their own. This post compares them side by side, from official sources, with fictional examples.

The application steps are in how to apply for OPT, and the start date is explained in start date and when you can work and on the OPT filing window page. The STEM rules in full are on the STEM OPT extension page.

Each row is explained below. The regulation links point to the eCFR as of Sept 14, 2026; see the Sources note.

A first OPT application is pending: work starts on the EAD start date

What the rules say

  • Not before the EAD date. "The student may not begin optional practical training until the date indicated on his or her employment authorization document, Form I-766" (8 CFR 214.2(f)(10)(ii)(A)). Likewise, a student "may not begin OPT employment prior to the approved start date" on the EAD, except for the STEM extension below (8 CFR 214.2(f)(11)(i)(D)).
  • Three things must happen. "You may begin OPT only after USCIS approves your Form I-765, you receive your EAD and the start date on the EAD arrives." (Study in the States, Applying for Practical Training) USCIS: "You may not begin your pre- or post-completion OPT until after we approve your Form I-765 and you receive your Employment Authorization Document (EAD)." (USCIS, OPT for F-1 Students)
  • Which date. "Employment authorization will begin on the date requested or the date the employment authorization is adjudicated, whichever is later" (8 CFR 214.2(f)(11)(i)(D)).

A receipt notice isn't an EAD

USCIS's Handbook for Employers explains that the Form I-9 receipt rule covers people who are already authorized to work but lack the document. It says: "You cannot accept a receipt showing the employee has applied for an initial grant of employment authorization and/or an EAD." (M-274, 14.0, question 7) The handbook also says F-1 students "must obtain an EAD from USCIS before they are authorized to work pursuant to OPT" (M-274, 7.4.2).

Your status while you wait is a separate question

For a student "with approved post-completion OPT," duration of status begins "on the date that the student's application for OPT was properly filed and pending approval" (8 CFR 214.2(f)(10)(ii)(D)). That paragraph is about status, not permission to work. The work rule is the EAD start date above. If the application is denied instead, see Your OPT application was denied: what happens next?

When the unemployment count starts

SEVP's OPT guidance says: "OPT authorization begins on the employment start date shown on the student's EAD." (§7.1.6, SEVP Policy Guidance 1004-03) Days while the application is pending, before that date, aren't unemployment days. EADly and the unemployment days calculator count from the EAD start date. ICE says this 2010 guidance "remains in effect," except where its 17-month STEM content conflicts with the 2016 STEM rule (ICE, Practical Training).

Fictional example: an offer before the card arrives

Fictional dates. Not your dates. Maya's program ends May 15, 2026. She requested a June 1, 2026 start date, and USCIS receives her Form I-765 on March 20, 2026. She has a job offer for May 18, 2026.

  • On May 18 her application is still pending. Under the rules above, a receipt notice doesn't let her start.
  • USCIS approves the application on June 10, 2026. The regulation says authorization begins on the later of the requested date and the approval date: June 10, 2026. The start date printed on her EAD is the one that counts.
  • Her unemployment count starts on the EAD start date, not on May 15 or the day the card arrives.

Maya tells her employer about the EAD rule and asks her DSO before agreeing to a start date.

A STEM OPT extension is pending: up to 180 days

What the rules say

  • The extension. If your STEM Form I-765 was timely filed and is pending when your OPT EAD expires, "Employment is authorized beginning on the expiration date of the Form I-766 ... and ending on the date of USCIS' written decision on the current Form I-765 or successor form, but not to exceed 180 days" (8 CFR 274a.12(b)(6)(iv)).
  • The conditions. It applies if you "timely and properly" file the application and "timely and properly" request a DSO recommendation, "including by submitting the fully executed Form I-983" (8 CFR 214.2(f)(11)(i)(C)).
  • Received before the OPT end date. SEVP says STEM OPT employment authorization begins the day after your OPT end date "if USCIS received the Form I-765 before your post-completion OPT end date." It adds: "If USCIS receives your Form I-765 after the end date for your post-completion OPT, the STEM OPT extension application will be denied." (Study in the States, Applying for Practical Training) The SEVIS Help Hub puts it as received "before the EAD for the original post-completion OPT expired" (SEVIS Help Hub, STEM OPT). Ask your DSO how this date applies to you.
  • It ends at the decision. "This automatic 180-day extension ceases once USCIS adjudicates your STEM OPT extension application." (USCIS, STEM OPT)

Form I-9 while the STEM application is pending

USCIS's employer handbook lists the documents (M-274, 7.4.2):

  • "An expired EAD presented with Form I-20 endorsed by the student's designated school official recommending a STEM extension if the student timely filed their Form I-765 but their application is still pending."
  • "If the student has changed employers, this Form I-20 must also contain the new employer's information."
  • The employer enters "the date 180 days from the Card Expires date on the EAD" and "EAD EXT."

The handbook's STEM row doesn't list the Form I-797C receipt notice. It lists the I-797C only in the cap-gap row. Keep your STEM receipt notice anyway: it shows when USCIS received your application.

Unemployment days during the extension

The days you used on OPT carry over. While a timely STEM application is pending after your OPT EAD expires, EADly applies the 150-day limit for up to 180 days. The reasons, and the regulation's wording, are in How OPT unemployment days are counted. Confirm with your DSO.

If the STEM application is denied

If your OPT EAD has expired, the Policy Manual says "OPT employment authorization ends on the date of the decision" (USCIS Policy Manual, Ch. 5). The rest is in the STEM section of our denial post.

Fictional example: the 180-day outer limit

Fictional dates. Not your dates. Ravi's OPT EAD says "Card Expires" June 30, 2026. USCIS received his STEM application on June 1, 2026, with his DSO's recommendation and a signed Form I-983.

  • On July 1, 2026 his STEM application is still pending. His employer can use the expired EAD with his STEM-endorsed Form I-20.
  • The handbook has his employer enter the date 180 days from the "Card Expires" date: December 27, 2026. EADly uses the same date as the outer limit.
  • If USCIS decides earlier, the extension ends on the decision date.

Cap-gap: when an H-1B petition is pending

Cap-gap isn't an OPT application. It applies when your employer files a cap-subject H-1B petition requesting a change of status.

  • The rule. Your duration of status, "and any employment authorization granted under 8 CFR 274a.12(c)(3)(i)(B) or (C)," is "automatically extended until April 1 of the fiscal year for which such H-1B status is being requested or until the validity start date of the approved petition, whichever is earlier" (8 CFR 214.2(f)(5)(vi)(A)). Those two categories are post-completion OPT and the STEM extension.
  • Work only if your OPT was valid at filing. USCIS: "F-1 students who have entered the 60-day grace period are not authorized to work." If the petition is filed during the grace period, the student "will receive the automatic extension of their F-1 status, but will not be authorized to work" (USCIS, cap-gap). For Form I-9, "timely filed" means filed while the D/S admission was in effect "and before the expiration date of the EAD" (M-274, 7.4.2).
  • The last covered day. The extension runs "until" April 1, so EADly treats March 31 as the last covered day, or the day before an earlier approved start date. The employer handbook has employers record "March 31" and reverify "on or by March 31." Sources state the end date differently: the USCIS Policy Manual still says the cap-gap period "ends on October 1." Details are in F-1 to H-1B: cap-gap and the grace period.
  • Form I-9. "The employee's expired EAD in combination with your Form I-797C, Notice of Action, showing the above requirements is an unexpired EAD under List A. This automatic extension ends if the H-1B petition is rejected, denied, revoked, or withdrawn." (M-274, 7.4.2)
  • Your proof. USCIS says the updated Form I-20 from your DSO "is not required for a student to continue working; it merely serves as proof of the extension" (USCIS, cap-gap).

Fictional example: pending vs. approved

Fictional dates. Not your dates. Lena's OPT EAD expires June 30, 2026. Her employer files a fiscal year 2027 cap-subject H-1B petition requesting a change of status, and USCIS receives it on April 1, 2026, while her EAD is valid.

If the petition is...Last day cap-gap covers, as EADly counts it
Still pendingMarch 31, 2027 (the day before April 1 of fiscal year 2027)
Approved with an October 1, 2026 start dateSeptember 30, 2026 (the day before the approved start)
Rejected, denied, revoked or withdrawnThe extension ends then. See the cap-gap post for the grace period

If her employer had filed after June 30 but during her grace period, cap-gap would extend her status only, with no work authorization.

On-campus jobs after you finish your program

Many students hold a campus job until graduation. The regulation is specific about what happens after that:

  • "An F-1 student may not engage in on-campus employment after completing a course of study, except employment for practical training as authorized under paragraph (f)(10)." The exception: a student with a Form I-20 for a new program "who intends to enroll for the next regular academic year, term, or session at the institution that issued the Form I-20 ... may continue on-campus employment incident to status" (8 CFR 214.2(f)(9)(i)).
  • ICE answers the grace-period question directly. "May an F-1 student work on campus during the 60-day grace period after the program end date? No." It adds that the student "may consider applying for post-completion OPT to continue working after graduation" (ICE, SEVIS employment FAQ).
  • The employer handbook: F-1 students "may work on campus without approval from USCIS until they complete their course of study" (M-274, 7.4.2).

None of these sources lists a pending OPT application as an exception. If your campus job could run past your program end date, ask your DSO before your last day of classes.

Unpaid and volunteer work: what the sources say

This is the area where official sources say the least, so here they are word for word:

  • On post-completion OPT, "A student may work as a volunteer or unpaid intern, as long as this practice does not violate any labor laws, and the employment is related to the program of study. The student must work at least 20 hours per week." (USCIS Policy Manual, Vol. 2, Pt. F, Ch. 5) SEVP's guidance lists "Unpaid employment" among the types of OPT employment (§7.2.1, SEVP Policy Guidance 1004-03).
  • Unrelated volunteering. "A volunteer position that is not directly related to an F-1 student's course of study does not qualify as optional practical training (OPT)." "Non-qualifying positions do not stop the accrual of unemployment." (Study in the States, Reporting Volunteer Positions During OPT Employment, July 5, 2018)
  • STEM OPT. "If you are completing a 24-month STEM OPT extension, you must receive compensation for your training opportunity" (same page). USCIS says a STEM student may not work for the employer "on a 'volunteer' basis" (USCIS, STEM OPT).

Flag: no official answer for the pending period. We found no official statement on whether unpaid or volunteer activity is allowed before your EAD start date. The Policy Manual describes qualifying volunteer and unpaid-intern work as OPT employment, and the regulation says OPT employment may not begin before the EAD start date. We don't draw a conclusion from that. Ask your DSO before you start any role, paid or unpaid, while your application is pending.

How long will it be pending? How to check

This post doesn't list processing times, because they change. Use the official tools:

  • Processing times. USCIS publishes them on its Check Case Processing Times page. Choose Form I-765 and the right category.
  • Case status. Enter the receipt number from your Form I-797 in Case Status Online or check your USCIS online account. USCIS says Case Status Online "will show the last action taken on your case."
  • When to ask USCIS. Through USCIS's online tools you can create a service request for a "case outside normal processing time" (USCIS Policy Manual, Vol. 1, Pt. A, Ch. 4). After approval, USCIS says to "allow a total of 30 days from approval before inquiring" about a card that hasn't arrived (USCIS, Form I-765).
  • Premium processing. It's available for Form I-765 categories (c)(3)(B) and (c)(3)(C). USCIS guarantees "adjudicative action" within 30 business days for Form I-765 or refunds the premium fee (USCIS, premium processing). The fee for the OPT and STEM OPT categories is $1,780 under fee schedule G-1055, edition 10/16/26 (G-1055). The action can be an approval, a denial, a request for evidence or a notice of intent to deny, so it isn't always a decision. More in OPT premium processing.

Travel while an application is pending has its own risks. See Travel on OPT.

Keeping track in EADly

EADly is a private, local-first app for iPhone and Android. While you wait, it can help you keep the dates straight:

  • Employment records only accept job dates inside a work period you've saved: your EAD dates, a pending STEM extension (up to 180 days) or cap-gap (through March 31, or the day before an earlier approved start). EADly Free saves every F-1 job (OPT, STEM OPT and CPT).
  • While you wait lets you copy the date the official processing-times page shows and sets a check-in reminder.
  • USCIS receipts saves your receipt number and opens the official USCIS Case Status site. It doesn't fetch your status itself.
  • The OPT step-by-step guide has a "While you wait" step: don't start work until you have the card and its start date arrives.

What it doesn't do: EADly doesn't decide whether you may work, doesn't check your case with USCIS and doesn't report anything to your DSO, SEVIS or your employer. A date you copy into the app is not an approval date.

Get EADly on the App Store or Google Play. It's a free download.

Common questions

Can I start working with my OPT receipt notice?

No. The regulation says OPT employment may not begin before the approved start date on your EAD, and USCIS's employer handbook says an employer cannot accept a receipt for an initial grant of employment authorization.

When can I start work on post-completion OPT?

Study in the States says only after USCIS approves your Form I-765, you receive your EAD and the start date on the EAD arrives. The regulation says authorization begins on the later of the requested start date and the approval date.

Can I keep working while my STEM OPT extension is pending?

If your STEM application was timely and properly filed, with your DSO's recommendation, and USCIS received it before your OPT EAD expired, the regulation extends your current work authorization until USCIS decides, for no more than 180 days. Your employer can accept the expired EAD with your STEM-endorsed Form I-20.

What if I filed for STEM OPT after my OPT EAD expired?

Study in the States says a STEM application USCIS receives after your post-completion OPT end date will be denied. There is no 180-day extension for it.

Does cap-gap let me work while my H-1B petition is pending?

Only if your OPT or STEM OPT was valid when the petition was filed. USCIS says a petition filed during the 60-day grace period extends F-1 status but not work authorization. EADly treats March 31, or the day before an earlier approved start, as the last covered day.

Can I keep my on-campus job after graduation while OPT is pending?

The regulation says an F-1 student may not engage in on-campus employment after completing a course of study, except practical training, unless continuing to a new program at the same school. ICE says on-campus work during the 60-day grace period is not allowed.

Can I volunteer while my OPT application is pending?

We found no official statement that answers this. The Policy Manual treats qualifying volunteer work as OPT employment, and OPT employment can't begin before the EAD start date. Ask your DSO first.
